This presentation will analyze the requirement for impartiality and neutrality, in fact and appearance. It will also analyze the principle of conflict of interest in the mediation process. The presentation will address how attorney-mediators can identify and avoid conflicts of interest under the Florida Rules for Certified and Court-Appointed Mediators. This will include a review of the rules governing conflicts of interest. This program will be helpful for attorney-mediators and will be informative for non-mediator attorneys, who mediate with their clients, to ensure they do not ask a mediator to breach ethical obligations related to mediation. The presentation will include hypothetical fact patterns presenting possible conflicts of interest and analysis of how to avoid or disclose the conflicts.
